The laws that govern both the employment law and the employee benefits law environments are constantly changing, so employers must constantly adapt their business practices and procedures to remain current.  With appropriate employment policies and procedures, employers can avoid unjustified claims, ensure compliance with applicable laws, and evade the ordinary hazards frequently encountered when hiring, disciplining, and terminating employees.  Additionally, with the recent enactment of the Pension Protection Act (PPA), the employee benefits arena has changed and employers need to ensure their plans’ compliance with this new law.  At Aiken and Aiken, prevention is our primary goal.

Our expertise includes working and advising clients on all types of employment law and employee benefits matters including designing, reviewing and revising policies, practices and plans and their associated documents in accordance with current laws.  We assist our clients both throughout the entire life cycle of employment and employee benefits and any stage in between.  In employment law matters we can assist from the initial hiring phase of the employment relationship through termination, including issues that arise during the course of employment such as FMLA, FLSA, and disciplinary issues.  In employee benefits matters we can assist from the initial start of a plan, through plan qualification with the IRS, implementation of the plan including auditing of administrative procedures, ongoing changes to comply with current law and client representation on all matters relating to their employee benefits.  In addition, we assist our clients who have existing policies and plans with any current and future needs they have and provide resolution including bringing them into compliance and working with governmental agencies to resolve any matters.
